That will also deter the multi-billion dollar "birth tourism" problem. Ends sanctuary cities, verifies immigration status of all arrested and booked, and increases prison sentences for previously deported illegal alien felons.

Q - How many signatures are required?

A - Approximately 420,000, but 600,000 are needed for insurance, with five months to obtain signatures. The two page petition when available can be downloaded, copied to one page front and back, and then signed.

Q - Won't the police complain if we end Special Order 40 and sanctuary cities?

They will have the discretion to inquire of immigration status when necessary. The United States Supreme Court ruled unanimously in 2005 that a peace officer has the ability to inquire of immigration status without having reasonable suspicion. This law will help to reduce crime and eliminate harboring criminal aliens.

Q - What if people complain that this initiative denies pre-natal care to an illegal alien?

A - California spends over $3 billion dollars each year to pay for the births to illegal aliens and birth tourists. This program opened the door to health care and welfare to anyone who can find a way to enter the United States, even for a very short time. We have to deter these births; prenatal care has become a major magnet which has caused a high teenage birth rate. More doctors have contributed to this campaign than any other profession, they know the costs incurred by illegal aliens accessing the health care system.

In addition, the American Legion is very concerned that even illegal alien criminals, drug dealers and terrorists can give birth to a citizen. Also the lifetime dual citizenship that is granted with most of these births raises the question of loyalty and the ability to avoid a potential compulsory military service.

Q - How can California report applications for federal, state and local services for children born here with parents who are here illegally?

A - Pursuant to federal law 8 USC 1644, the state has the ability to report these applicants.

In addition, an article in the Sacramento Bee on September 10, 2007 by Washington correspondent David Whitney summed up automatic citizenship: "Although Congress has never passed a law saying so, no president has ever ordered it, and no court has ever ruled on the issue, each of these babies automatically becomes a U.S. citizen when it takes its first breath."
